Photography Terms & Conditions

Booking Fee & Payment

A booking is confirmed once the agreed booking fee has been received.

Unless stated otherwise in the quote, the standard booking fee is £200. Larger productions may require a different booking fee, which will always be confirmed before booking.

The booking fee:

• reserves the agreed shoot date;

• covers scheduling and initial preparation;

• forms part of the total project fee rather than being an additional charge.

Once a date has been reserved, I may turn down other work for that time, so please let me know as early as possible if plans change.

Unless different payment terms have been agreed in writing, the remaining balance is due within 7 days of invoice and before final high-resolution images are released.

For established corporate clients, agencies or organisations with their own payment cycles, alternative payment terms can be agreed in advance.

Invoices may include any additional costs agreed during the project, such as extra shooting time, travel, assistants, props, location fees or additional retouching.

Final image delivery may be held until overdue invoices have been paid.

Cancellation & Rescheduling

Plans change, and wherever possible I would much rather reschedule a shoot than cancel it.

If a shoot is moved with at least 4 days’ notice, the booking fee can normally be transferred to one new date, subject to availability.

If a Client cancels or postpones at shorter notice, I may retain some or all of the booking fee to cover preparation already carried out and the loss of the reserved date.

For cancellations within 24 hours of the shoot, or where the Client does not attend or provide access, the booking fee will normally be retained.

Any cancellation charge will be reasonable and will reflect the work already carried out, committed costs and the loss caused by the cancellation. Where I am able to rebook the date or otherwise reduce that loss, this will be taken into account.

Any non-refundable third-party costs already approved by the Client, such as assistants, travel, accommodation, equipment hire or location fees, may also remain payable.

Repeated rescheduling may require a new booking fee.

Weather, Light & Unavoidable Events

Interior and hospitality photography can be highly dependent on natural light and weather.

Where schedules allow, the Client and Photographer may agree to move a shoot if the forecast is likely to significantly compromise the agreed brief.

If I recommend rescheduling because of unsuitable conditions but the Client chooses to proceed, limitations caused by those conditions will not normally be grounds for a free reshoot.

If illness, severe weather, major transport disruption or another event outside either party’s reasonable control makes the shoot impossible, we will first try to agree a new date.

If I am unable to carry out the work and a suitable replacement date cannot be agreed, payments relating to work that has not been provided will be refunded as appropriate.

Shoot Times, Delays & Overtime

The booked shooting time begins at the agreed start time.

Please make sure the property, team and any subjects are ready at that time. Delays caused by access, styling, cleaning, staff availability or other Client-side circumstances may reduce the number of photographs that can be completed within the booked session.

If additional shooting time is required, it is subject to availability and will be charged at the additional-hour or overtime rate agreed for the project.

If I arrive late because of circumstances within my control, the booked shooting time will be adjusted accordingly.

Access, Styling & Permissions

The Client is responsible for making sure that the property or location is:

• accessible at the agreed time;

• clean and reasonably prepared;

• styled and ready for photography where styling is the Client’s responsibility.

I am not responsible for reduced coverage caused by incomplete preparation, restricted access or delays outside my control.

Unless we have agreed otherwise, the Client is also responsible for obtaining any permissions required for the shoot, including permission from property owners, locations, employees, models or other identifiable people appearing in the photographs.

If artworks, branded materials or other third-party content are specifically requested in the photographs, the Client is responsible for ensuring any necessary permissions are in place.

Image Delivery & Editing

Final edited images are normally delivered within 12 business days of the shoot and once any payment due before delivery has been received.

• Faster turnaround may be available by agreement and may carry an additional fee.

  Images are normally supplied as:

  • full-resolution edited JPEG files suitable for print and professional use; and

  • web-optimised JPEG files where required.

  Delivery may be through a private gallery, WeTransfer or another secure download service.

  RAW files, unedited images, test frames and unused photographs are not supplied unless specifically agreed in advance.

Editing & Retouching

My photography and editing style forms part of the service.

I retain creative discretion over composition, lighting, colour treatment and image selection while working within the agreed brief and the visual style shown in my portfolio.

Standard post-production includes:

• colour correction;

• exposure and tonal balancing;

• perspective and crop adjustments where appropriate;

• general image refinement.

Extensive retouching, compositing, major object removal, reconstruction or substantial alterations are not included unless agreed as part of the project.

If you believe an image contains an editing error or that I have materially missed something agreed in the brief, please let me know promptly and I will work with you in good faith to resolve it where reasonably possible.

Additional creative revisions or retouching outside the agreed scope may be quoted separately.

Because photography is a creative service, a change in personal preference alone will not normally be grounds for a refund where the work has been delivered in accordance with the agreed brief and professional standard.

Client Usage Licence

Unless a different licence is stated in the project quote, the named Client receives a non-exclusive, worldwide and ongoing licence to use the delivered images for their own business, brand or project.

This includes:

• websites;

• social media;

• digital marketing;

• paid advertising;

• printed marketing materials;

• brochures and presentations;

• press and PR activity;

• editorial submissions;

• awards and industry submissions;

• internal communications.

The licence begins once the agreed project fees have been paid in full.

The Client may crop or resize images as reasonably necessary for different formats. Significant editing, filters or alterations that materially change the appearance of the photography should be discussed with me first.

The images may not be resold, offered as stock photography, used on merchandise for resale, or otherwise commercially exploited outside the agreed Client use without permission.

Agencies, Press & Third-Party Use

The licence belongs to the named Client.

The Client may provide images to employees, designers, web developers, social media teams, PR agencies and other suppliers where those parties are using the images solely on behalf of the Client.

Those suppliers do not receive their own independent licence to use the photographs for their own marketing or portfolio.

The Client may also provide images to newspapers, magazines, websites and other media for editorial coverage of the Client or photographed project.

However, architects, developers, estate agents, contractors, manufacturers, furniture brands, suppliers, designers or other businesses wishing to use the photographs for their own promotion require a separate licence.

They are very welcome to contact me directly and I can arrange this quickly.

Photography Credit

Where reasonably practicable, please include a photography credit.

For editorial publication, the publication’s normal credit format is fine.

I understand that credits are not practical in every form of advertising or marketing. Where a credit would normally be included, I ask that reasonable efforts are made to include one.

If a credit has accidentally been omitted, I simply ask that it is added where reasonably possible once brought to the Client’s attention.

Portfolio & Self-Promotion

For commercial projects, I may use selected photographs on my website, portfolio, social media, awards entries, industry features, presentations and other self-promotional material.

Where a project is confidential, under embargo or not yet publicly launched, I will respect any restrictions agreed in writing.

Where appropriate, I am also happy to wait until the Client has launched or published a project before sharing it myself.

For private or domestic commissions, or where identifiable individuals are involved and separate permission is required, images will not be used publicly without the appropriate consent.

Storage & Archiving

I normally retain backup copies of delivered images for 12 months from the delivery date.

This is provided as a convenience rather than a permanent archive service, so Clients should download and safely back up their photographs after delivery.

After 12 months, files may be permanently deleted without notice unless extended storage has been agreed.

Client details and any personal data contained in photographs are handled in accordance with applicable UK data-protection law and my Privacy Policy.

Travel & Additional Production Costs

Any travel, accommodation, parking, permits, assistants, equipment hire, props, couriers or other production costs that are not included in the original photography fee will be agreed with the Client wherever reasonably possible before they are incurred.

Unexpected minor costs necessary to complete the agreed brief will be communicated as soon as practical.

Copyright

Copyright in the photographs remains with Elina Pasok / Elina in Focus unless a separate copyright assignment has been agreed in writing.

Purchasing photography does not automatically transfer copyright.

A full copyright assignment or expanded exclusive licence can be discussed separately where a project genuinely requires it.

Liability

I will carry out the photography service with reasonable care and skill.

Nothing in these terms excludes or limits any responsibility that cannot legally be excluded.

For business Clients, and to the extent permitted by law, my total liability arising from a project will not exceed the fees paid for that project. I will not be responsible for indirect or consequential business losses such as loss of profit, loss of opportunity or loss of future business.

In the unlikely event that photographs are lost or damaged before delivery because of equipment failure, file corruption or another technical problem, I will make reasonable efforts to recover the files or arrange a reshoot where practical. Where neither is possible, the appropriate photography fee will be refunded.

Once final files have been delivered, the Client is responsible for keeping their own secure backup.

Private Clients & Consumer Rights

If you are booking photography as an individual for purposes mainly outside your business or profession, you may have additional legal rights as a consumer.

Nothing in these terms removes or reduces those rights.

Where a consumer booking is made remotely — for example by email, telephone or online — statutory cancellation rights may apply.

If you ask me to begin preparation or provide services during any applicable cancellation period and later cancel, you may be responsible for the reasonable value of work already carried out where the law allows.

The Agreement

The project agreement consists of:

• the project quote or booking confirmation;

• the agreed brief and deliverables; and

• these Terms & Conditions.

Any changes should be agreed in writing. Email is perfectly fine.

If there is a conflict between these general terms and a specific written project agreement, the project-specific agreement takes priority.

Governing Law

These Terms & Conditions are governed by the laws of England and Wales, subject to any mandatory consumer rights that may apply.

Nothing in these terms affects rights that cannot legally be excluded or restricted.

By booking a photoshoot, the Client agrees to the terms set out above.
